Air Conditioners in a Condominium: Noise and Emissions

The outdoor AC unit can disturb neighbors with noise and hot air. Here are the limits of normal tolerability under Article 844, respect for facade decorum and what to do about intrusive emissions.

Installing an air conditioner in a condominium is generally possible, but the outdoor unit must respect two sets of limits: the architectural decorum of the facade, which is a common part, and the normal tolerability of emissions towards the neighbors, governed by Article 844 of the Italian Civil Code. Noise, vibrations and jets of hot air must not exceed the threshold beyond which the emission becomes unlawful. The single owner may use the common wall under Article 1102, but cannot impair the equal use of the others nor alter the aesthetics of the building.

The decorum limit on the facade

The facade is a common part and cannot be modified freely. Even if the system is private, the outdoor unit affects the appearance of the building and remains subject to the limit of architectural decorum set by Articles 1120 and 1122. The placement must be as low-impact as possible; the condominium regulation may indicate dedicated areas, such as shafts or parts not facing the street, or prescribe uniform installation methods for all units.

Emissions and normal tolerability

Article 844 allows noise, heat and similar propagations only if they do not exceed normal tolerability, also having regard to the condition of the places. The criterion is relative: it depends on the context, the intended use of the area and the concrete situation. In civil matters case law tends to assess tolerability by comparing the background noise with that produced by the system, according to a differential criterion, distinct from the limits set by administrative rules to protect public health.

  • The outdoor unit must not alter the architectural decorum of the common facade.
  • Noise must not exceed normal tolerability compared to background noise.
  • Jets of hot air must not intolerably invade the neighbor's property.
  • The regulation may indicate uniform positions and installation methods.

Distances and hot-air jets towards the neighbor

Besides noise, a frequent problem is the emission of hot air from the outdoor unit towards the neighbor's windows or balconies. Here too the normal-tolerability criterion applies: a jet that makes someone's space unusable in summer may be unlawful. The placement must therefore be designed to direct the flow away from the adjoining openings. Any distances between buildings provided by law or by the regulation must be respected where applicable.

What to do about intrusive emissions

Someone suffering intolerable emissions may first report the problem to the manager and the installing owner, requesting corrective measures such as relocating the unit, adding anti-vibration mounts or shielding. A sound-level survey carried out by a technician can document the exceeding of normal tolerability. If the amicable route is not enough, judicial protection remains available to obtain the cessation of the emissions and any compensation for damage.

Maintenance and conflict prevention

Many disturbances arise from undersized, badly installed or poorly maintained systems. A noisy air conditioner is often so because of wear, dirt or undamped vibrations. Periodic maintenance reduces noise and extends the life of the system. On the condominium level, setting clear criteria for the installation of outdoor units in the regulation prevents most disputes between neighbors.

The manager's role

The manager oversees compliance with the regulation and decorum, collects reports and may urge the owner to come back within the limits. He has no power to resolve on his own a civil dispute over emissions, which remains between the parties, but his mediation and the proper documentation of reports are often decisive in avoiding escalation.
