Water Dripping From the Balcony Above: What to Do

Watering plants, dripping laundry and air-conditioner condensate falling onto the balcony below are a classic cause of disputes. Here is who is responsible and how to act, from a friendly word to nuisance protection.

Water dripping from the balcony above, from watering plants, dripping hung laundry or air-conditioner condensate, is a frequent and often underestimated disturbance. Legally it falls among the nuisances of Article 844 of the Italian Civil Code and may trigger the balcony owner's liability for the damage caused, under the keeper's liability principle of Article 2051. Remedies start with an amicable talk and reach, if necessary, a formal notice and a claim for damages.

Whoever uses the upper balcony must do so without causing harm or annoyance to those below. Repeated dripping wets the floor, outdoor furniture and the neighbour's laundry, leaves stains and can foster infiltration and mould. This is no trivial annoyance: when continuous, it affects the enjoyment of the property below and exceeds normal tolerability.

The useful distinction is between occasional dripping, tolerable and tied to normal balcony use, and systematic dripping arising from avoidable behaviour or badly managed systems. Only the latter justifies formal action.

Typical causes and who is responsible

Identifying the cause is essential to know who to turn to and how to resolve it.

  • Over-watering plants: the owner must water moderately and prevent water from spilling over
  • Laundry dripping beyond the parapet: avoidable behaviour, often regulated by the condominium rules
  • Uncollected air-conditioner condensate or drainage: an obligation to collect and dispose of condensate water properly
  • Waterproofing or slope defects on the balcony: here you must distinguish between exclusive-ownership parts and parts that may affect shared decor or structure

Air-conditioner condensate

A recurring case is split-unit condensate falling onto the balcony below. Anyone installing an air conditioner must channel the condensate into a proper drain and not let it drip onto someone else's property. Continuous dripping may amount to an unlawful nuisance and require the owner to remove the cause and compensate for damage. The technical fix, simple and cheap, is a dedicated drainage line to a suitable point.

First step: the amicable route

Often the person causing the dripping does not notice, because the water falls out of sight. A courteous conversation, with a request to adopt practical measures, resolves most cases without friction. It helps to show, with photos, the effect of the dripping on the balcony below.

If the relationship is difficult, it is best to move to a written report and involve the manager, especially when the rules contain provisions on balcony use or when the problem touches waterproofing, which can affect common areas.

Rules, manager and penalties

Many regulations forbid hanging dripping laundry beyond the parapet or watering in a way that wets lower floors. Where valid clauses exist, the manager can contest the breach and apply the penalty under Article 70 of the implementing provisions of the Italian Civil Code, up to 200 euros and up to 800 for repeat offences. The manager is also entitled to check any waterproofing defects that may affect the shared structure or decor.

If the amicable route is not enough, send a formal notice by registered letter or certified email, describing the disturbance and demanding it stops. If it persists, you may go to court to have the nuisance stopped under Article 844 of the Italian Civil Code and obtain compensation for the damage caused, also invoking the keeper's liability under Article 2051. A mediation attempt is usually required before litigation. Useful evidence includes dated photos and video, testimony and, for infiltration, a technical report.
