Returning Documents at End of Mandate: Duties and Remedies
On leaving office the outgoing manager must return every document of the condominium and of the individual owners. They cannot hold them pending payment of their own claims: the right of retention does not apply here. Here are the duties and remedies.

At the end of the mandate the outgoing manager must hand over all documentation in their possession relating to the condominium and to the individual owners, without being able to hold it pending payment of their own claims. Article 1129, paragraph 8, of the Italian Civil Code provides so, and also requires the performance of urgent activities to prevent harm to common interests, with no right to further compensation. The right of retention, that is holding the documents until settlement, is not allowed: any claims must be asserted separately.
The duty to hand over is unconditional
Article 1129, paragraph 8, sets a clear duty: on cessation of office, for whatever reason, the manager hands over all documentation in their possession. The obligation is unconditional; it is not subject to payment of sums the manager believes are owed by the condominium. The documentation belongs to the community and to the owners, not to whoever physically held it during the management.
The handover must be complete and orderly, so that the new manager can carry on seamlessly. Dumping disordered boxes is not enough: the handover must allow full reconstruction of the accounting and administrative situation.
What must be handed over
The duty covers the entire documentary record of the management, in paper and digital form.
- Condominium register with the data of owners and occupants
- Register of meeting minutes and register of appointment and removal of the manager
- Accounting register with chronological entries of movements
- Approved statements, budgets, bank statements, and banking documentation
- Contracts with suppliers, insurance policies, invoices, and expense receipts
- Technical documentation of the systems and mandatory certifications
Why the right of retention does not apply
The outgoing manager cannot make the handover conditional on payment of their claims. The right of retention, the power to hold another's property as security for a claim, is exceptional and is allowed only in the typical cases provided by law: returning condominium documentation is not among them. A manager who claims fees or reimbursement of advances must first hand over the documents and then assert their claim in the appropriate forum, without holding the condominium's activity hostage.
Remedies against refusal to hand over
If the outgoing manager does not return the documentation, the condominium has concrete tools. The first step is a formal notice to deliver within a set period. If it goes unanswered, the new manager may file an urgent petition under Article 700 of the Code of Civil Procedure, asking the judge to order the handover, a measure suited to preventing the harm of management paralysis.
Refusal also exposes the outgoing manager to financial consequences: they may be ordered to reimburse the condominium the costs incurred to reconstruct accounting lost or made inaccessible by the failure to hand over, in addition to any damages.
How to manage an orderly handover
An efficient handover is prepared throughout the management, not only at the moment of departure. Orderly accounting, documents filed by category, and a structured digital copy make the handover quick and verifiable, reducing the risk of disputes over missing documents.
- Prepare a handover record listing in detail the documents transferred
