Wrong Expense Allocation Found After Report Approval

An allocation error found after approval is not a final verdict. Here is the difference between wrong application and breach of criteria, and the concrete remedies.

If the expense allocation turns out to be wrong after the report is approved, the remedy depends on the type of error. If it is a simple wrong application of a correct criterion, for example the use of mistyped thousandths (millesimi), the resolution is voidable and must be challenged within thirty days under Article 1137 of the Italian Civil Code, or corrected by a new resolution of the meeting. If instead the allocation changed the statutory or contractual criteria without unanimity, the resolution is null and can be contested without time limits.

Identifying the nature of the error

The first step is to understand whether the allocation criterion applied was right but executed poorly, or whether the criterion itself was wrong. The first case includes calculation errors, the use of outdated thousandths tables, and the charging of an expense to a table different from the correct one. The second case, by contrast, includes the choice of an allocation criterion that conflicts with Article 1123 of the Italian Civil Code or with the contractual regulation.

Wrong application: voidable resolution

When the criterion is correct but applied wrongly, case law classifies the resolution as voidable. This means the defect must be asserted within thirty days from the resolution for dissenting or abstaining attendees, and from notification of the minutes for absentees. Once the deadline passes, the resolution becomes final and the wrong allocation is consolidated, unless the meeting itself decides to rectify it.

Breach of criteria: null resolution

If the allocation applied a criterion different from the one imposed by law or by the contractual regulation, for example splitting equally an expense that Article 1123 requires to be split by thousandths, the resolution is null. Nullity can be asserted at any time and by anyone with an interest. In this case the meeting cannot cure the error by a majority: to validly change the statutory or contractual criteria, unanimity is required.

Expenses subject to special criteria

Many allocation errors arise from the failure to apply the special criteria set by the Italian Civil Code for certain expenses.

  • Stairs and lift: half allocated by thousandths and half by floor height, under Article 1124
  • Roof terrace in exclusive use: one third borne by the user and two thirds by the owners of the covered building, under Article 1126
  • Conservation expenses versus use expenses, which follow different rules based on use
  • Improvements and common parts serving only some owners, charged only to those who benefit

Remedies for the manager

Once the error is discovered, a prudent manager does not wait for a challenge but convenes the meeting for rectification, presenting the corrected allocation and the adjustment statement. This approach reduces litigation and shows diligence. If the error is such as to make the resolution null, rectification requires unanimity for the part affecting the criteria; otherwise the manager must simply restate the amounts correctly without altering the statutory criteria.

Effects on owners

Correcting the allocation generates credits and debits among owners. Those who paid more than due are entitled to a refund or adjustment; those who paid less must top up. Transparency in communicating the new amounts is essential to prevent the rectification itself from becoming a subject of dispute. Every change must be documented and attached to the minutes.
