The condominium, despite lacking full legal personality, acts as a withholding agent for payments made in connection with contracts for works and services carried out in the course of a business activity. The administrator, as the legal representative of the condominium, is required to apply, report and remit the withholding, a duty that is woven into ordinary bookkeeping and demands attention at every payment made to a third party.
Who is subject to the withholding
The withholding applies to amounts due for services rendered under contracts for works or services, carried out in the course of a business, when the work concerns the common parts of the building. This typically covers construction firms handling extraordinary maintenance, installers of systems, cleaning and gardening companies, and even the property management firm itself when it operates as a VAT registered business. Payments to self employed professionals whose compensation falls under a different tax category are excluded, as are payments that are not consideration for a contracted service, such as utility bills.
The rate and the taxable base
The withholding is applied at a rate of 4 percent, as an advance payment on the supplier's own tax liability, calculated on the amount due net of VAT shown on the invoice. The condominium applies it at the moment of payment, not when the invoice is received: this means that if an invoice is settled in several installments, the withholding must be calculated on each payment actually made. This is a practical distinction that matters for bookkeeping: what counts is the cash outflow, not the accounting period of the document.
Remittance through the F24 form
Withholdings applied must be paid electronically using the F24 form by the 16th day of the month following the payment. The condominium must hold its own tax code, separate from those of the individual owners, and use the specific tax codes provided for withholdings on self employment or business income depending on the nature of the supplier. Many small condominiums do not exceed the minimum annual threshold of 500 euros in total withholdings due, in which case the payment can follow a different schedule, but the amounts withheld must still be tracked without exception.
The annual certification to the supplier
Within the deadline set by tax rules, the condominium must issue the supplier with a certification of the withholdings applied during the year, which the supplier then uses in its own tax return. Missing or late certification exposes the administrator to liability toward the supplier, who is left unable to prove the advance already paid on their behalf.
