Manager Succession and Continuity of Management

A change of manager must not interrupt the life of the condominium. Here is how to handle the succession without gaps: current account, ongoing contracts, debt recovery and priority checks.

The succession of a new manager is a delicate moment: the life of the condominium does not stop and payments, contracts and deadlines continue. To ensure continuity, the successor must quickly take control of the condominium current account, verify the ongoing dealings with suppliers and utilities, reconstruct the position of receivables and payables and complete urgent activities. An orderly succession avoids service interruptions and unexpected liability.

The condominium current account

Article 1129 of the Italian Civil Code requires the manager to route the condominium's funds through a specific current account in the name of the condominium. On succession it is necessary to update the signing powers at the bank, obtain access to statements and verify the actual balance. It is essential to reconcile the bank balance with the accounts handed over: any differences must be clarified at once, because they reveal unrecorded receipts or unjustified expenses.

Dealings with suppliers and utilities

  • List the active contracts (cleaning, elevator, heating, insurance)
  • Check the deadlines and any automatic renewals
  • Notify suppliers of the change of manager and the new contacts
  • Check the electricity, water and gas supplies in the condominium's name
  • Identify suspended or unpaid amounts that risk service disconnection

The position of defaulters

The successor also inherits the receivables from defaulting owners. They must reconstruct who owes what, check the status of any recovery procedures already started and continue them without interruption. Article 1129 requires the manager to act to collect receivables: neglecting inherited defaulters may result in liability. It is useful to ask the predecessor for the updated status of reminders and any orders obtained.

Urgent activities to complete immediately

Some activities cannot wait for the meeting: tax deadlines, payment of withholdings, safety obligations, open claims, works in progress with progress payments. The successor must identify these priorities in the first days, also seeking the cooperation of the outgoing manager, who by law must carry out urgent activities to avoid harm to common interests.

How long the previous manager remains liable

The end of the mandate does not erase the outgoing manager's liability for acts carried out during their management. They are answerable for the accuracy of the accounts they hand over and for the choices made in their period of competence.
