Awnings in a condominium: permits and building rules

Installing awnings in a condominium is usually free, but with limits. Here is when permits are needed, what the building rules say and how to respect the architectural decorum of the building.

Installing awnings in a condominium is one of the most frequent requests from owners, especially as summer approaches, and at the same time a recurring source of disputes. As a rule an individual can fit them on their own balcony without asking the meeting for permission, but this freedom meets clear limits: the architectural decorum of the building and any provisions of the building rules. Let us look at when authorisations are needed for awnings in a condominium and how to avoid disputes.

Awnings fall under free building works

From a planning point of view, installing an awning normally falls under the free building works provided by Presidential Decree 380/2001: no building permit is needed and no certified notice of commencement of works (SCIA) must be filed with the municipality. This applies to retractable awnings installed on balconies and windows without significant masonry work. The need to respect the condominium rules remains.

The limit of architectural decorum

The main constraint is the architectural decorum of the building, protected by articles 1120 and 1122 of the Civil Code. The awning must not alter the uniform look of the facade: colours, models and sizes sharply at odds with the building's appearance can be prohibited and justify a request for removal. For this reason many buildings adopt a single model and shade for all units, so as to harmonise the whole.

What the condominium rules can set

The condominium rules can regulate the installation of awnings, indicating the permitted colours, models, sizes and methods of fitting. If the rules are contractual in nature, that is accepted by all owners in their respective deeds of purchase, they can impose even strict limits. Before ordering the awning it is therefore essential to read the rules and any resolutions of the meeting on the matter.

When awnings in a condominium need the meeting's authorisation

For an awning installed on one's own balcony, which is for individual use, the meeting's authorisation is normally not required. Authorisation becomes necessary when the work affects common parts, for example if the awning must be anchored to the common facade with significant works, or when the rules expressly require it. When in doubt it is prudent to inform the administrator before proceeding.

Landscape constraints and historic centres

Where landscape constraints apply, or for buildings located in protected historic centres, building freedom is reduced: a landscape authorisation may be needed, or compliance with municipal rules on materials and colours. Before installing the awning it is worth checking with the municipal technical office for any such constraints, which prevail over the general rule of free building works.

  • Check with the municipality for any landscape or historic constraints.
  • Inform the administrator when the work touches common parts.

The most effective way to avoid disputes is transparency: telling the administrator the chosen model and, where appropriate, bringing to the meeting a proposal to make the awnings uniform. A resolution setting colour and type for the whole building prevents future conflicts and protects both the decorum and the individual's right to shade their own balcony from the sun.
