In these cases the decision on common rules can be adopted with the majorities of the assembly regulation, always respecting decorum.
The boundary with the right of enjoyment
The owner has the right to shade from the sun and to enjoy their own unit, but this right must be balanced against the protection of the building's appearance. Case law requires a concrete assessment: not every small difference harms decorum, an appreciable and not marginal alteration of the aesthetic character is needed. A building that is already uneven, where awnings of various types coexist, offers less protection than a well-kept and uniform facade.
Planning and landscape constraints
Beyond condominium rules, the installation may require building permits or authorisations when the building is in areas subject to landscape constraints or is among protected properties. It is prudent to check the situation before proceeding, to avoid removal orders from the competent authorities.
How to handle disputes
If an owner installs a non-conforming awning, the manager can formally warn them to restore compliance, citing the regulation and decorum.
