The Condominium Account: An Owner's Right to See It

Every owner has the right to know how the condominium's money is managed, and this includes the movements on the current account. Article 1129 of the Italian Civil Code grants each owner the right to ask the administrator to view and obtain a copy, at their own expense, of the periodic reporting of the current account held in the condominium's name. It is the cornerstone of the transparency intended by the 2012 reform: common money must always be verifiable by those who contribute to it.
What the law says about account transparency
Paragraph 7 of Article 1129 requires all condominium sums to pass through a specific current, postal or bank account held in the condominium's name. The following paragraph grants the owner, through the administrator, the right to view and obtain a copy of the periodic reporting of that account. The logic is clear: if the money must pass through a dedicated account, those who share the expenses must be able to check that account.
The right is individual: no resolution of the owners' meeting is needed to exercise it; each single owner can activate it independently by contacting the administrator.
What the owner can request
Transparency does not stop at the annual report; it extends to the management documents.
- The periodic reporting and the bank statement of the condominium current account.
- The accounting register with movements in chronological order.
- The supporting documents, that is invoices and payment receipts.
- The registry of owners, the register of minutes and the register of appointment and revocation of the administrator.
- Copies of the documents, at their own expense, not merely inspection.
How the right is exercised
The owner makes the request to the administrator, preferably in writing to leave a trace. The administrator must allow consultation in reasonable times and ways, without obstructing it, but the request must not turn into an obstacle to management: consultation should be arranged so as not to paralyse the office. The out-of-pocket costs for extracting copies, such as printing, remain with the requester.
The administrator cannot oppose a generic refusal. An unjustified refusal or the failure to produce accounting documents are serious behaviours that may amount to grounds for the judicial removal of the administrator.
Transparency and personal data protection
The right of access to condominium documents is coordinated with the personal data protection rules of EU Regulation 2016/679. The owner may learn the data needed to verify common management, including arrears positions that affect everyone's expenses, but the disclosure of personal information must be limited to what serves the purpose of control. The administrator, as data controller on behalf of the condominium, must balance transparency and confidentiality.

An administrator who makes account movements easily accessible prevents suspicion and disputes. The ability for owners to check income and expenses at any time reduces conflict at the owners' meeting and strengthens trust.
