How to exercise the right of access to condominium documents
The right of access to condominium documents is the tool that makes every check on the statement effective. Without being able to consult invoices, bank statements and contracts, verifying the accounts would remain theoretical. Article 1130-bis of the Italian Civil Code grants every owner the right to inspect and obtain, at their own expense, copies of the supporting documents of expenditure. It is a broad right, not limited to the meeting period, but one to be exercised correctly and not without genuine reason. What the law says
Article 1130-bis of the Italian Civil Code, after defining the content of the statement, establishes that owners and holders of rights in rem or of enjoyment over the units may inspect the supporting documents of expenditure and obtain copies at their own expense. This is the legal basis of the right of access.
The right is linked to the manager's duty of transparency, who under Article 1130 must keep and preserve the accounting documentation. Consulting the documents is not a concession but a right the manager must make effective, organising it so as not to paralyse the management.
Which documents you can consult
Access covers all the supporting documents of the management: supplier invoices and receipts, maintenance and supply contracts, statements of the condominium's current account, the accounting register, the owners' register and the minutes register. In practice, everything needed to understand and verify the condominium's financial management.
One limit concerns the personal data of other owners contained in the documents. Consistently with Regulation EU 2016/679 on data protection, access must be carried out so as not to disclose personal information beyond what is needed for accounting control. How to frame the request
The request goes to the manager, preferably in writing, so you have proof of the date. Precisely indicate the documents you intend to consult, the reference period and whether you wish only inspection or also copies. A clear request is harder to evade and speeds up the reply.
Then agree on an appointment for consultation or the method for sending the copies. The law does not set a precise deadline, but the reply must arrive within a reasonable time: an unjustified postponement or prolonged silence are improper behaviours you can report at the meeting.

Do I have to justify the request for access to documents?
It is not necessary to state a specific reason: the right to inspect and obtain copies of the supporting documents derives directly from Article 1130-bis of the Italian Civil Code and is inherent in the status of owner. The request, however, must not be made without genuine reason nor aimed at obstructing the management.
Can the manager charge me for the consultation?
Consultation of the documents alone is free. The cost of reproducing the copies you request, on the other hand, is yours to bear, as provided by Article 1130-bis. It is advisable to agree the cost of copies in advance to avoid later disputes.
Can I access the documents even if no meeting is scheduled?
