Returning a credit balance to the owner

A credit balance forms when the advances paid by the owner exceed the share due under the final statement. It is the opposite of a charge owed: here it is the condominium that must return the surplus. There are two main routes, offsetting against the first instalments of the following year and a direct refund. The choice belongs to the owners' meeting, which approves the final statement under Article 1135 of the Italian Civil Code and decides how to treat individual credits. This guide explains when each solution is preferable, with numeric examples and transparency criteria.

Why a credit arises

A credit arises when the budget was prudently high or when some estimated expenses did not occur. Once the final statement is approved, every owner with advances above their share closes in positive. It is a physiological situation and not an error, provided the difference is contained: systematically high advances signal a budget to be revised.

The credit is a position in favour of the individual owner, not a condominium fund: it must be managed with the same care as a debt, because the owner has the right to see it recognised and returned.

Offsetting against future instalments

Offsetting is the most common solution: the credit is deducted from the first instalments of the following year. It is convenient because it avoids cash movements and reduces the amount the owner must pay at the start of the new year. It must be clearly stated in the allocation plan, so the owner understands why the first instalment is lower.

Example: an owner with 250 euros of credit and a first instalment of 400 euros in the new year will pay only 150 euros. The credit is cleared and the position stays clean, with no outgoing transfers from the condominium account.

The direct refund

The direct refund returns the surplus with a transfer to the owner's account. It is the correct choice when the owner has sold the property and will have no future instalments to offset against, or when the credit is substantial and the party requests it. The payment must be traceable and pass through the condominium bank account, consistently with Article 1129 of the Italian Civil Code.

Before refunding it is worth checking that the owner has no other open debit positions, for example arrears instalments on another unit: in that case the positions are offset against each other before returning any residual.

The role of the resolution

The method of returning credits must be decided by the owners' meeting when approving the final statement. Many sets of rules provide, as a general rule, for automatic offsetting, unless a refund is requested. In the absence of indications, it is prudent for the manager to propose a uniform criterion and minute it, avoiding different treatment among owners in similar situations.

Transparency is essential: every owner must be able to read in their own statement the amount of the credit and how it was treated. Clear management prevents disputes and strengthens trust.

Can the owner demand a refund instead of offsetting?

The credit is a position in their favour, so they have the right to obtain it. The concrete method, offsetting or refund, depends on the rules and the owners' meeting resolution. In the absence of future instalments to offset against, for example after the sale of the property, the direct refund is the natural route.

Does offsetting require the owner's consent?

If the rules or the resolution provide for offsetting as a general criterion, the manager applies it by reducing the first instalments. It is nonetheless good practice to inform the owner in the individual statement, so the choice is transparent and does not cause misunderstanding about the instalment amount.

From which account is the refund made?

The refund must pass through the dedicated condominium bank account, consistently with Article 1129 of the Italian Civil Code, with a traceable movement. It is not correct to return credits in cash or from other accounts: every operation must appear in the condominium accounts.

What if an owner has both a credit and a debit?

The positions of the same party are offset against each other before returning any residual. If the debt exceeds the credit, a debit balance to pay remains; if the credit prevails, it is offset against future instalments or the difference is refunded, always with traceable movements.
