Article 1129 of the Italian Civil Code provides for this. The duty gives owners, and anyone dealing with the building such as suppliers, technicians or people involved in emergencies, a certain and always reachable point of contact. It is not an optional formality: its omission may count among the challenges to proper management.
What information must be posted
The details to make known concern the manager's identity and contact points. In practice the following must be displayed:
- the manager's personal details, or the name if it is a company;
- the domicile or registered office;
- the contact points, including the telephone, to be reached by owners and third parties;
- any professional details identifying the manager.
The aim is that anyone looking at the posting point can identify whom to contact for the condominium's matters, without having to look for information elsewhere.
Where the posting must be placed
The law indicates the condominium's access point or the place of greatest common use, provided it is accessible to third parties too. In practice this means the entrance hall, the doorway or the condominium noticeboard near the entrance. The placement must make the information easily visible: a hidden notice or one in a locked room does not meet the purpose of the rule. Reachability of the contact is especially important in emergencies, when a fault or flooding requires immediate action.
Updating when the manager changes
When the manager changes, the posted details must be updated with those of the new appointee. Leaving the outgoing manager's contacts on display creates confusion and can delay important communications. Among the new manager's first tasks after appointment is replacing the posting, just as they open or have the condominium account assigned to them and take over the documentation. Prompt updating is part of management continuity.
Posting and personal data protection
Posting the manager's contact points is expressly provided by law and serves a transparency purpose. The case of owners' personal data is different: it cannot be displayed on the noticeboard without a justifying basis. Publishing information about individual participants in common areas, such as arrears, is subject to the principles of the GDPR and should be avoided where unnecessary. The posting duty concerns the manager, not the owners.
What a manager who does not post the details risks
Failure to post is a breach of a legal duty. Although, on its own, it is not among the serious irregularities that automatically justify judicial revocation, it contributes to a picture of untransparent management and can be reported by the owners. At the meeting, participants may ask the manager to comply and check that the posting is present and up to date. It is a simple detail to respect, but telling of the manager's attention to legal duties.
