Condominium tax code: how to obtain it and why it matters

Every condominium is an autonomous tax entity and must have its own tax code. Here is how to apply with the AA5/6 form, who files the request and why it is essential for bank accounts, contracts and deductions.

A condominium is neither an individual nor a company, yet it is still an autonomous tax entity and therefore must hold its own tax code (codice fiscale). It is obtained by filing form AA5/6 with the Italian Revenue Agency, the application for the attribution of a tax code to entities other than individuals. The request falls to the condominium manager, or to a delegated owner in buildings without a mandatory appointment, and is needed to open the bank account, sign contracts and manage the owners' deductions.

Why a condominium needs a tax code

The condominium is a management entity without legal personality, but the law treats it as an autonomous centre of tax relationships. Without a tax code it cannot hold a dedicated condominium bank account, a requirement that Article 1129 of the Italian Civil Code imposes on the manager so that each building's funds flow through a separate account. The tax code is also essential to enter into works, supply or lease contracts, to pay withholdings and to send tax communications to the Revenue Agency.

Obtaining the tax code does not create any VAT obligation: as a rule, the condominium does not carry out commercial activity. The tax code simply identifies the entity in its dealings with the tax authorities, banks and third parties.

The AA5/6 form and who files it

The application is filed using form AA5/6, downloadable free of charge from the Revenue Agency website. In condominiums with more than eight owners the appointment of a manager is mandatory and the request is up to the manager. In smaller condominiums, where the appointment is optional, the application may be filed by one of the owners acting on behalf of the community.

The form requires the name of the condominium, the full address of the building and the personal details and tax code of the representative filing the request. It is good practice to attach or keep at hand the minutes of the owners' meeting appointing the manager, which prove the power of representation.

How the application is submitted

Submission can take place in several ways:

  • through the online service "Consegna documenti e istanze" available in the reserved area of the Revenue Agency website;
  • by certified email (PEC) sent to any Provincial Directorate;
  • by direct delivery to a local office of the Agency, including through a delegated person carrying a proxy and identity document.

The tax code is attributed as the application is processed. Once obtained, it remains unchanged for the entire life of the condominium: it does not change when the manager changes.

What changes when the manager is replaced

When the owners' meeting appoints a new manager, the condominium's tax code is not affected because it belongs to the entity, not to the person. However, the change of representative must be reported to the Revenue Agency, again using form AA5/6, ticking the data variation box. This is an often overlooked step that causes misalignments: tax communications and correspondence keep being addressed to the former manager until the update is made.

The outgoing manager is required to hand over all documentation to the successor, including the condominium's credentials and tax references. Keeping these data tidy avoids delays in later duties, such as the communication of expenses for the pre-filled tax return or the filing of the AC schedule.

The tax code in super-condominiums and buildings under construction

The super-condominium too, that is a set of several buildings sharing common systems or services under Article 1117-bis of the Italian Civil Code, is an autonomous entity and must have its own tax code, distinct from that of the individual condominiums that compose it. The same applies, in some cases, to a condominium still being completed once the first common-expense management begins.

Keeping the tax codes of the different entities separate is essential for the correct allocation of expenses, deductions and communications: an attribution error can charge one building with costs and duties that belong to another.

Verifying the tax code and keeping it up to date

The attributed tax code can be verified through the Revenue Agency's online services. It is advisable to check it periodically to ensure that name, address and representative are correct and aligned with the real situation of the condominium. A tax code linked to a manager no longer in office or to a wrong address can block the opening of an account or the registration of a contract.
