The law does not require paper form, and the accounts may also be kept with electronic tools. Moving to digital, if done with method, reduces space, search time and the risk of loss, without weakening the value of the documents.

The duties to retain condominium documents

Article 1130 of the Civil Code requires the administrator to keep certain registers: the register of meeting minutes, the register of appointment and removal of the administrator, the register of condominium residents and the accounting register. To these are added suppliers' invoices, the bank account documents and every other paper relating to the management. The duty covers both the relationship with owners and the technical and administrative status of the building.

How long they must be kept

The general time limit is ten years from registration, consistent with the ordinary limitation periods. It is the period within which an owner can challenge a management or assert a right, and for this reason the documentation must remain available. Destroying a document too early exposes the administrator to liability, because it deprives them of proof of what they did and complicates the recovery of the condominium's claims.

Registers kept with electronic tools

The law expressly allows the accounting register to be kept in electronic form, and the same logic extends to the ordinary management of the other documents. This opens the way to digital retention: documents that are digital by origin, such as electronic invoices, stay digital throughout their life cycle, while paper documents can be digitised for daily use, taking care to preserve the originals where their paper form retains value.

Legal value and integrity of the digital document

For a digital archive to be reliable it is not enough to scan the papers. What matters is integrity, that is the guarantee that the document has not been altered, legibility over time and the ability to establish the date. For documents that must retain full evidential value over time there is compliant retention, a process that ensures these characteristics. For current management it is in any case prudent to keep orderly, dated copies that cannot be changed without leaving a trace.

Handover to the successor

When the administrator ceases the engagement, they must hand over to the new administrator or to the meeting all the documentation in their possession. An orderly digital archive makes this transfer fast and verifiable: the handover happens through folders and files consistent with the registers, without boxes and without scattered documents. A missing or incomplete handover is one of the typical causes of dispute between the outgoing administrator and the condominium.

The benefits of digital retention

Beyond saving space, digital offers immediate search by date, supplier or type of document, backup against fires and floods that destroy paper archives, and shared access for owners who have the right to inspect and obtain copies of the supporting documents. A well organised archive reduces the time spent looking for an invoice from years earlier and strengthens the transparency of the management.

Which documents to keep beyond the registers

The duty of retention is not exhausted by the four registers required by law. The administrator must keep suppliers' invoices and contracts, the statements and slips of the condominium bank account, insurance policies, the documents of extraordinary works with their specifications and certifications, tax communications and the receipts of payments made as a withholding agent. Relevant correspondence with owners and suppliers also belongs fully in the archive, because it can serve to reconstruct decisions and to defend the management in the event of a challenge.

Ordering this mass of documents by condominium and by financial year is the premise of effective retention.
