A poorly maintained installation puts people's safety at risk and exposes the person managing it to liability. The governing framework is the Italian decree DPR 162/1999, which regulates the commissioning, maintenance and periodic inspection of lifts in service.
Why maintenance is mandatory
The lift is subject to a strict safety regime, because its operation directly affects the safety of those who use it. DPR 162/1999 requires the owner of the installation to ensure its maintenance and to submit it to the required inspections. In a condominium the owner of the common installation is the community of owners, and the duty to ensure compliance falls on the administrator, who acts as their representative.
The qualified maintainer
Maintenance must be entrusted to a person holding a certificate of qualification or to a specialised firm. It cannot be improvised: whoever carries out the work must have the technical competence required by law. With the firm a maintenance contract is signed that defines the interventions, the frequency of visits and availability in the event of a breakdown or of people trapped in the car, a situation that requires a rapid response. It is good practice to compare several quotes and to check that the contract clearly distinguishes the routine maintenance included in the fee from extraordinary work and the replacement of components, which are normally charged separately.
What the maintainer does
The maintainer carries out periodic checks and verification of the safety devices on the installation. In summary, the work covers:
- preventive maintenance visits on the correct operation of the main components, such as landing doors, locks and ropes;
- cleaning and lubrication of the parts that require it;
- verification of the integrity and efficiency of the devices on which the lift's safety depends;
- recording of the interventions and prompt reporting of any faults that require taking the lift out of service.
The periodic inspections
Beyond routine maintenance, the law provides for periodic inspections. Article 13 of DPR 162/1999 states that these inspections take place every two years on all categories of lifts in private service. They serve to ascertain that the parts on which safety depends are in working order, that the safety devices function correctly and that the requirements set out in previous inspections have been met.
Who carries out the periodic inspections
The periodic inspections are not carried out by the maintainer, but by an independent qualified body, that is an authorised certification body or the competent public authority for the area. The distinction matters: the maintainer looks after the installation over time, while the inspector checks, as a third party, that the installation is safe. The owner, through the administrator, must provide the means and the cooperation needed for the inspection to take place.
What happens if faults emerge
If the inspection finds defects that affect safety, the inspector reports them and the lift can be stopped until the faults are corrected. In that case the administrator must promptly call the maintainer for the necessary work and inform the owners. Putting an installation with known defects back into service exposes the person responsible to serious liability, including criminal liability, in the event of an accident.
The administrator's responsibilities
The administrator is answerable for the correct management of the installation: entrusting maintenance to a qualified party, having the periodic inspections carried out within the required time, keeping the reports and documentation, following up on the requirements and informing the meeting of the necessary work. Keeping deadlines and documents under control is not a bureaucratic detail, but the proof that the legal obligation has been met. In the event of an accident, the accurate documentation of the maintenance and inspections is what makes it possible to show that the management was diligent and to distinguish the responsibilities of the administrator, the maintenance firm and the inspection body.
