The roof is a common part of the building
Article 1117 of the Civil Code includes roofs and roof terraces among the common parts of the building, unless the deed of purchase provides otherwise. The covering serves all the floors below, since it protects them from leaks and the weather. This common nature is the starting point for understanding who pays for maintenance.
Ordinary and extraordinary maintenance
Ordinary maintenance covers recurring, minor works, such as replacing a few tiles or cleaning the gutters, and falls among the expenses the administrator can order within current management. Replacing the roof, by contrast, is extraordinary maintenance: it requires a resolution of the meeting and, for works of significant value, the setting up of the special fund provided by article 1135 of the Civil Code.
How condominium roof maintenance costs are allocated
When the roof covers the whole building, maintenance and replacement costs are split among all owners in proportion to their thousandths of ownership, under the general rule of article 1123 of the Civil Code. Since it is an asset that protects every unit alike, no differentiated use criteria apply: whoever owns more thousandths contributes more.
The exclusive use roof terrace
The case of a roof terrace over which one owner has exclusive use is different, for example the terrace of the penthouse. Article 1126 of the Civil Code sets a special rule: whoever has exclusive use bears one third of the repair or reconstruction cost, while the remaining two thirds fall on the owners of the building, or of the part of the building, for which the terrace acts as covering, in proportion to thousandths. Ordinary maintenance linked only to enjoyment stays instead with the person using the terrace.
The majorities to resolve on the works
Extraordinary maintenance and major replacements require a resolution of the meeting with the majorities of article 1136 of the Civil Code. For urgent works aimed at avoiding damage, such as a temporary covering after a collapse, the administrator can order the indispensable works and then report to the meeting. The distinction between urgency and planning affects both responsibilities and timing.
