How to Send the Notice: PEC, Registered Mail, Fax, Hand

The notice convening the owners' meeting must be communicated by one of the means listed in Article 66 of the implementing provisions of the Italian Civil Code: certified electronic mail, registered mail, fax or hand delivery. These are not optional forms: using a different channel, such as an ordinary email or an informal message, does not provide legal proof of receipt and can make the resolution voidable. The choice of means directly affects how easily compliance with the notice period can be demonstrated.
The means permitted by law
The condominium reform specifically standardized the communication channels to overcome past uncertainties. Every listed means shares the ability to document that the notice was addressed to the owner and, as a rule, when it was received. The form serves the proof: in the event of a dispute, the administrator must be able to show that each entitled party was reached within the deadline.
Certified electronic mail (PEC)
PEC is today the most efficient means. It generates an acceptance receipt and a delivery receipt with a certain date and time, has virtually no marginal cost, and eliminates delivery times. The limit is that it requires the owner to have a PEC address: the administrator can only use it toward those who have communicated and accepted that address. It is good practice to collect PEC addresses in the register and to keep the delivery receipts, which serve as proof that the five-day deadline was met.
Registered mail with return receipt
Registered mail remains the universal channel, usable toward anyone with a physical address. Proof of receipt is given by the return receipt or, if the recipient is absent, by completed postal storage. The disadvantage is the cost per item and the need to send early to absorb postal times, calculating the notice period from the delivery date and not from the sending date. A digital version of registered mail also exists, combining evidentiary value and speed.
Fax and hand delivery
Fax is permitted but increasingly rare: proof is the transmission report, which however documents sending and not necessarily reading. Hand delivery is fully valid and economical, typical of small condominiums, but it requires the recipient to sign a dated receipt. Without a signed receipt, hand delivery becomes hard to prove in court.
- PEC: firm proof of date and delivery, minimal cost, requires the owner's PEC address.
- Registered mail: universal, proof via return receipt or storage, higher cost and time.
- Fax: permitted, proof via transmission report, now residual.
- Hand delivery: economical, valid only with a signed and dated receipt.
Proof of receipt is what is really at stake
Whatever means is chosen, the goal is to have enforceable proof that each individual owner was duly notified within the deadline. In any challenge, the burden of proving correct convocation lies with the administrator. That is why relying on informal channels is unwise: a plain email or a message on chat applications is not among the standard means and does not offer the same certainty.
Mixed convocation and an up-to-date register
In practice the condominium is often heterogeneous: some owners have PEC, others must be reached by registered mail, others accept hand delivery. Nothing prevents using different channels for different recipients, provided each receives the notice by a permitted means and within the deadline. The prerequisite is an accurate condominium register with verified contact details, because a wrong address is equivalent to a failed convocation.
