Condominium facade renovation permits are one of the topics that generates the most uncertainty among property managers and boards, because it combines two different levels: the urban planning level, which concerns the municipality and the building titles required, and the assembly level, which concerns owner consent and cost sharing. Before calling the meeting to approve the work, it is essential to understand which building procedure applies and which majority is required under the Italian civil code, to avoid repeating the vote or, worse, ending up with work carried out without a valid title.

When a building permit is needed for the facade

The facade is both a structural and an aesthetic element of the building, so any work that changes its appearance, materials or finishes falls under municipal building regulations. In most cases, simple repainting that reproduces existing colors and materials qualifies as ordinary maintenance and does not require a building title, unless the local building regulation states otherwise. More significant work, such as changing the color, adding new cladding, or altering cornices, balconies or openings, falls under extraordinary maintenance and requires an asseverated notice of commencement of works (CILA) or, in more significant cases, a certified notice of activity start (SCIA).

It is always the property manager, supported by a qualified technician, who must verify which title is required based on the municipal building regulation, which can impose additional constraints beyond national rules, especially in historic centers or areas subject to landscape protection.

Architectural decorum and landscape constraints

Beyond the building permit aspect, the facade is protected under article 1120 of the Italian civil code in terms of architectural decorum: no owner may, through an independent intervention, alter the building's appearance in a way that harms its overall harmony, even when the work concerns only their own unit, such as a window or a balcony visible from the outside. If the building is located in an area subject to landscape or historical protection, an additional authorization from the Superintendency is required, which assesses the compatibility of materials and colors with the surrounding context.

Scaffolding and public land occupation

Renovating a facade almost always requires scaffolding, and if it occupies sidewalks or public streets, a municipal authorization for occupation of public land is required, along with a related fee and, often, an order modifying traffic or parking arrangements. The property manager must handle these requirements together with the contractor, also checking construction site signage and any liability insurance for third parties, since scaffolding remains in place for weeks and is exposed to risks such as falling materials or intrusions.

Maintenance or innovation: why the distinction matters

From an assembly standpoint, whether the work is classified as extraordinary maintenance or as an innovation directly affects the majority required. Restoring the facade to its original condition, even using modern materials but keeping the same appearance, is extraordinary maintenance. If the work instead introduces a new appearance, such as a different color or a new cladding system, it can be classified as an innovation under article 1120, which still requires respecting architectural decorum and a qualified majority at the assembly.

The assembly majorities required

For extraordinary maintenance of the facade, the assembly resolves at a second call with the majority of those present representing at least one third of the building's value, following the general rules of article 1136 of the civil code. When the work also has an energy efficiency component, such as facade insulation, the reduced majorities provided for energy innovations may apply, which are easier to reach than the ordinary majorities required for purely decorative innovations.

How facade renovation costs are shared among owners

Facade renovation costs are shared according to general ownership shares, unless the contractual condominium bylaws set different criteria. Whether a unit directly faces the facade in question is not relevant for the cost split: the facade is a common asset in every respect and benefits the entire building in terms of decorum and preservation, so the cost falls on all owners according to their respective shares, except for specific cases governed by the bylaws.

Available tax deductions

Facade renovation can benefit from the ordinary tax deductions available for building recovery work, with percentages and spending limits that are periodically updated by budget laws, so it is worth checking the rules in force when the work begins.
