Condominium Withholding Deadlines: The Tax Calendar

An orderly reminder of a condominium withholding agent's deadlines: when to pay withholdings via F24, when to file the CU and when the 770.

A condominium acting as a withholding agent follows a precise tax calendar: withholdings are generally paid by the 16th of the month following payment, the 4% withholding on contracts follows a threshold rule with half-yearly deadlines, the Certificazione Unica is filed by 16 March and the 770 return by 31 October. Meeting these dates avoids penalties and keeps the condominium's accounting orderly.

Monthly payment by the 16th

The general rule is that withholdings applied in a month are paid with the F24 form by the 16th of the following month. This applies to the 20% withholding on the manager's fee, the 20% on professional services and withholdings on any employment income, for example that of a concierge employed by the condominium. If the 16th falls on a Saturday or a public holiday, the deadline moves to the first following working day.

The special rule for the 4% on contracts

The 4% withholding on consideration for works and services contracts, set by Article 25-ter of DPR 600/1973, has followed a different schedule since 2017. The condominium is not required to pay it every month: it waits until the total amount withheld reaches 500 euros, then pays by the 16th of the month following the one in which the threshold was crossed.

  • It is paid when cumulative withholdings reach 500 euros
  • In any case it is paid by 30 June and 20 December, even if the threshold has not been reached
  • Tax codes 1019 for personal income tax recipients and 1020 for corporate income tax recipients are used
  • This rule applies only to the 4% on contracts, not to the 20% on self-employment

In practice, a condominium with few expenses subject to this withholding will end up paying twice a year, in June and December; a condominium with many works sites will reach the 500-euro threshold more often and pay in the months in which it is crossed.

Single certification: 16 March

By 16 March of the following year the condominium must deliver to recipients and send to the Italian Revenue Agency the Certificazione Unica for the fees paid and withholdings applied in the previous year. The CU concerns the manager, professionals, businesses subject to the 4% and any employees. It is the document each recipient will use to offset the withholding in their own return.

770 return: 31 October

The 770 return is the summary declaration of the withholding agent and is filed electronically by 31 October of the following year. It summarises all withholdings applied and paid, the related tax codes and the recipients' data. It must reconcile with what is certified in the CUs and with the F24 payments made during the year.

A summary calendar

  • By the 16th of each month: F24 payment of the 20% withholdings applied in the previous month
  • On reaching 500 euros, and in any case by 30 June and 20 December: payment of the 4% on contracts
  • 16 March: filing and delivery of the Certificazione Unica
  • 31 October: filing of the 770 return

Note: the dates indicated may move to the first available working day when they fall on a Saturday or public holiday, and it is always advisable to check any annual extensions granted by the tax authorities.

What happens if a deadline is missed

Late or omitted payment of a withholding exposes the condominium to penalties. The remedy is voluntary correction (ravvedimento operoso): the tax due is paid together with a reduced penalty and statutory interest, the sooner the correction the lower the amount. Late filing of the CU or 770 also entails penalties, often based on the number of late certifications.
