Condominium outdoor paths and paving

Uneven paths and degraded paving cause falls and liability. Here is how to manage maintenance, root damage, accessibility and drainage of shared outdoor areas, with resolutions and cost allocation.

Paths, walkways and outdoor paving of the common areas are common parts under Article 1117 of the Italian Civil Code and their maintenance falls on the condominium. Uneven paving, lifted by roots or slippery, is one of the main causes of falls and claims for compensation. The condominium, as custodian under Article 2051, is liable for damage unless it proves a fortuitous event. The custodian's liability

Falls on shared outdoor paths and paving are behind many condominium disputes. Liability rests on Article 2051 of the Civil Code: the condominium, custodian of the thing, is liable for the damage caused unless it proves a fortuitous event, which may include the injured party's own imprudent conduct. An unmarked step, a lifted tile, a slippery slab are hazards that expose the community to liability. That is why monitoring the state of paving is not optional but a duty to diligently preserve the common parts.

The most frequent damage

Outdoor paving suffers from frost, roots, subsoil settlement and wear. The roots of shared trees are a classic cause of lifting: as they grow, they push up slabs and paving blocks, creating dangerous height differences. Frost and infiltration degrade the joints and the subsoil. A monitoring programme that identifies critical points in time, before they become hazards, is useful.

Roots and paving: how to act

When the roots of shared trees lift the path, the work must reconcile the safety of the route with the health of the plant. Drastically cutting the roots can compromise the tree's stability and increase the risk of a fall, as well as exposing to liability. The correct solutions involve an agronomist's assessment, the possible rerouting of the path, the use of root barriers or raised paving. If the roots encroach onto the neighbour's land, the principles of Articles 896 and 2051 of the Civil Code apply.

Accessibility and drainage

Maintaining outdoor areas is also an opportunity to improve accessibility. Overcoming steps with compliant ramps, ensuring obstacle-free routes and non-slip paving helps elderly and disabled people and reduces the risk of falls. Rebuilding a path is the right moment to correct slopes and drainage: proper management of rainwater prevents pooling, dangerous ice and infiltration towards basements and garages.

Who decides and with what majorities

Small paving repairs fall within the ordinary maintenance handled by the administrator under Article 1130 of the Civil Code, who in case of danger may act urgently under Article 1135. Rebuilding a path or a courtyard's paving is an extraordinary expense and must be resolved by the meeting with the majorities under Article 1136. If the work introduces improvements that alter the layout, such as a new ramp or different paving, the rules on innovations under Article 1120 may apply.

Cost allocation

The maintenance and rebuilding costs of shared outdoor paving are shared among the owners according to their thousandths (millesimi) of ownership, under Article 1123 of the Civil Code. If a path or courtyard serves only some owners, for example the access to a group of garages or a single block, the cost is charged only to the owners who benefit. Documenting the state of the sites with dated photos, alongside quotations and invoices, is also useful as a defence against claims for compensation.
